About the Probate Court
Georgia Probate Courts hold exclusive, original jurisdiction over matters including the probate of wills, estate administration, guardianships of minors and adults, and involuntary hospitalizations. The Probate Court also issues birth and death certificates, marriage licenses, weapons carry permits, and administers oaths of office.

Probate of Estates:
The Probate Judge has original jurisdiction in the probate of wills and administration of estates. You may access probate forms/petitions by going to http://www.gaprobate.org and click on Standard Forms-Georgia Juridical Gateway. The probate court can store the Last Will and Testament of living person in the vault for safekeeping. The fee for filing a Last Will and Testament for safe keeping is $15.00. The Probate court has jurisdiction regarding appointment of guardians (of minors and incapacitated adults). The Probate Judge can issue orders to apprehend for involuntary evaluation for an adult who suffers from a mental health and/or alcohol and drug addiction.
Vital Records:
The Probate Judge serves as the Toombs County Registrar as the county custodian of vital records which include birth and death certificates. Our office has access to all birth and death records for the State of Georgia. You must have a valid photo ID in order to request a birth and/or death certificate. Certified copies of birth and death records are $25.00 for the first copy and $5.00 for each additional copy of the same record. Errors to birth certificates may be corrected by filing an amendment within our office. Please call our office if we can answer any questions regarding amendments, paternity acknowledgments and delayed certificates of birth.
Marriage License:
Both parties need to be present with a valid photo ID to complete an application for marriage. If either party has been married previously, you must bring in a certified copy of a final divorce decree or a death certificate if previous spouse is deceased. The fee for a marriage license is $76.00 unless you’ve had marriage counseling previous to purchasing the marriage license. The fee is $36.00 if the couple had counseling. We have the counseling forms in our office which must be completed and signed (in the presence of a notary) by the individual providing the marriage counseling. Certified copies of marriage records are $10.00 for the first copy and $5.00 for an additional copy.
Weapons Carry License:
We accept new applications and renewals Monday through Friday from 8:30 AM until 4:00 PM. You must have a valid State of Georgia ID or driver’s license which shows your physical address in Toombs County. The fee for a new applicant is $74.00 and to renew is $31.00. You must be 21 years of age to apply, however, a license can be issued to a younger applicant if he/she is active military. Upon application for a new carry license, the applicant will be immediately directed to the Toombs County Sheriff’s Department for fingerprinting. The fingerprint fee is $5.00 cash only. A background check is run through GCIC, ICE, NICS, and FBI. The weapons carry licenses are good for five years and can be renewed 90 before expiration or 30 days after expiration. If approved for a weapons carry license, the license will be mailed to the applicant. Senate Bill 319-Consittutional Carry-This office cannot provide direction or guidance on the ramifications of the “Constitutional Carry” legislation which is now in effect other than to note that this legislation does not affect the issuance of weapon carry licenses.
